
The Special Prosecution Office is seeking the arrest of the Deputy Prime Minister, and is asking the Assembly to lift Belinda Balluku’s immunity.
Following the Constitutional Court’s decision to reinstate Belinda Balluku, SPAK has tightened preventive measures against the Deputy Prime Minister, calling for her arrest.
In a media release, it is stated that Spak submitted to the Assembly on Tuesday a request to remove Balluk’s mandate, where in addition to the charges for which she has been charged, other cases for which she is under investigation are also listed.
The Deputy Prime Minister, who is also the Minister of Infrastructure and Energy, has been accused of committing the criminal offense of “Violation of equality of participants in public tenders or auctions” in connection with the prosecution procedures of the Llogara Tunnel.
SPAK has also listed seven other prosecution procedures, 6 of which are regarding the construction of the Tirana Ring Road, where the Deputy Prime Minister is suspected of committing the same criminal offense as with the Llogara tunnel.
“Completion and continuation of the works on Sheshi Shqiponja-Lumi i Tiranës, Lot 1 and QMT; Construction of the road segments Sheshi Shqiponja-Bulevardi i Ri, Lot 2 and Lot 3; Construction of the Tirana Outer Ring Road, Lot 4 to Lot 7” – stated in the SPAK announcement.
A few seconds after the announcement, Prime Minister Edi Rama reacted on the X network, considering this “a rude fad” that has led to an increase in the number of detainees and called it a “shameful fact” unrelated to European democratic standards.
Rama stressed that the Socialist Party will not prejudge SPAK’s request, but will prepare a “fair, clear and worthy” stance as the country’s leading force.
“…this time we are asked to give our opinion, we will engage with all our responsibility before the Albanians who gave us 83 mandates, and we will prepare to maintain a fair, clear and dignified stance,” the Prime Minister said .
On the other hand, Democratic Party MP Jorida Tabaku wrote on her official Facebook page regarding SPAK’s announcement and Rama’s reaction, where the latter, according to her, will not hand it over.
“…the socialist majority seems determined to vote against SPAK’s request,” says MP Tabaku in the post.
It is not the first time that prosecutors have requested coercive measures for Deputy Prime Minister Balluku as part of the investigations being conducted against her.
Initially, she was investigated without security measures for violating equality in tenders, where messages from the former director of the Albanian Roads and Highways Agency, Ervis Berberi, suggested that road tenders were directed by the minister and the winners were chosen by her, while the competitions were fictitious.
Judge Erjon Çela decided on November 20 to suspend Balluk from office and block her passport, highlighting the risk of repetition of the actions by the deputy prime minister. But the Constitutional Court’s decision on December 12 restored her to office, accepting Rama’s argument that the separation of powers had been violated and that the appointment of the minister was the exclusive competence of the prime minister.
SPAK’s counterattack

After being reinstated by court decision, SPAK has escalated the arrest request, attempting to impose stricter security measures against Belinda Balluku.
Rama, meanwhile, is taking a clear stance against the authorization, maintaining Balluku’s defense, while emphasizing that he cannot prejudice prosecutors, but will responsibly provide the majority opinion.
Since October 31, when Deputy Prime Minister Balluku was indicted, and on November 20, when the measure “Suspension of the exercise of a public duty or service” was taken, the country’s Prime Minister Edi Rama has made a series of statements in her defense.
Earlier, the Prime Minister described the GJKKO decision as violating the executive’s powers and unbalancing the powers.
In addition to the statements, the Prime Minister also appealed the decision of the Special Court to the Constitutional Court.
“Resolving the dispute over competence created between the Prime Minister and the Council of Ministers on the one hand, and the Special Court of First Instance for Corruption and Organized Crime” – was the request of the Prime Minister of the Republic of Albania.
On December 12, 2025, the Constitutional Court held a hearing to determine whether the decision of the Constitutional Court of Kosovo jeopardized the constitutional powers of the executive branch. By a majority vote, it was decided to suspend the decision to suspend Balluk from office.
While a public plenary session on Balluk’s fate was expected to be held on January 22, 2026, the Special Prosecution Office issued a decision today that she should be arrested.

“I wish the new Chief Prosecutor of SPAK, Klodian Braho, to take SPAK to another level in terms of professionalism in the fight against organized crime and especially in the fight against corruption in this last 3 years of the 9-year cycle, ” said the head of government.
